1. Scope and Applicability
These Terms and Conditions (“Terms”) apply to the use of the website https://faircado.com, the Faircado mobile app, and the integrated checkout services (together the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.2. Our Role as a Marketplace
Faircado UG operates as a marketplace platform. We enable users to search for products, compare offers, and complete purchases via integrated checkout. Important: Faircado does not own, hold, or sell the products offered. When you purchase a product through the Platform, the sales contract is concluded directly between you (the buyer) and the third-party seller (the merchant). Faircado is not a contractual party to the sales agreement. Faircado acts solely as a technical facilitator and intermediary, providing the platform and processing payments on behalf of the seller.3. Account Registration
To use certain features of the Platform, such as checkout, you may be required to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities carried out under your account.4. Ordering and Payment
When you place an order through our Platform:- The product information is provided by the seller.
- The order constitutes an offer to purchase from the seller.
- Payment is processed securely via third-party providers (e.g. Stripe).
- Faircado does not store your payment details.
5. Prices, Shipping and Delivery
All prices displayed on the Platform include applicable taxes unless stated otherwise. Shipping costs and delivery times are determined by the seller. Faircado is not responsible for shipping or delivery of products.6. Right of Withdrawal & Returns
As a consumer in the EU, you have a statutory right of withdrawal of 14 days from receipt of the goods, unless an exception applies. For further information, access our returns and refunds policy. The withdrawal, return, and refund process is handled by the seller in accordance with applicable consumer protection laws. Faircado may facilitate communication and refund processing through the Platform but does not assume the seller’s obligations.7. Warranties and Product Liability
Product descriptions, quality, warranties, and statutory guarantees are the responsibility of the seller. Faircado is not liable for product defects or for the fulfilment of warranty obligations. Faircado ensures that sellers comply with applicable EU consumer rights, but Faircado itself is not the seller of record.8. Limitation of Liability
Faircado is liable only for damages caused by intent or gross negligence. For simple negligence, Faircado is only liable for breach of essential contractual duties (cardinal obligations) and limited to foreseeable, typical damages. Faircado is not liable for:- product defects or misrepresentations by sellers,
- delays or failures in shipping,
- indirect or consequential damages.
